TERMS OF SERVICE

This Terms of Service Agreement ("Agreement") is entered into between Sheila Bee LLC, doing business as Pretty Balloons ("Company"), and the client ("Client"), who agrees to engage the Company's services for balloon decoration. By proceeding with a booking and submitting a payment, the Client acknowledges and agrees to the following terms and conditions:


Booking and Payments

  • A non-refundable initial payment of fifty percent (50%) of the total invoice amount ("Deposit") is required to secure a booking date. Booking is confirmed once the deposit is received and cleared.
  • The Deposit will be applied toward the total balance. The remaining balance must be paid in full prior to delivery/setup.
  • Accepted payment methods include:
  • Zelle
  • Venmo
  • Credit/Debit Card (via Stripe) – full payment only
  • Late payments will incur a late fee of $25 per week, beginning the day after the remaining balance is due.


Cancellation Policy

  • Deposits are non-refundable; however, a credit equal to the deposit amount may be applied to one future event within one (1) year, provided the Company remains operational. Credits are non-transferable.
  • No credit will be issued for cancellations made within three (3) days of the scheduled event.


Changes to Orders

  • Any changes must be communicated at least seven (7) days prior to the event.
  • Design alterations or modifications may incur additional charges, including the full cost of new décor, materials, and expedited shipping.
  • Changes requested within seven (7) days of the event cannot be guaranteed.


Delivery and Setup

  • The Company will deliver and set up balloon decorations at the agreed-upon venue.
  • The Client is responsible for:
  • Ensuring venue accessibility
  • Securing any necessary permissions, contracts, or insurance
  • Providing accurate event details and schedule modifications
  • The Company is not responsible for delays caused by venue restrictions or unforeseen events beyond its control.


Liability

  • The Company is not liable for any accidents, injuries, or damages before, during, or after the delivery and setup.
  • The Company is not liable for allergic reactions resulting from balloons, sprays, backdrops, or any other materials.
  • The Client agrees to indemnify and hold Sheila Bee LLC, dba Pretty Balloons, including all principals, owners, employees, contractors, and related parties, harmless from any claims arising from the use of the decorations.
  • The Company shall not be liable for any indirect incidental, or consequential damages arising from use of decorations or equipment.


Conditions

  • Balloon longevity cannot be guarantee; external factors such as sunlight, rain, wind, heat, rough handling, or sharp objects may cause balloons to pop or deflate prematurely.
  • Balloon spray/shine may stain fabrics or create slippery surfaces.


Balloon Frames and Equipment Use

  • Frames and equipment are provided for the event duration and must be returned in original condition within twenty-four (24) hours unless otherwise agreed.
  • The Client assumes full responsibility for loss, theft, or damage and may be charged the full replacement cost.
  • Frames must be placed on level surfaces and handled with care. The Company is not liable for accidents, injuries, or damages resulting from improper use.


Photography and Promotion

  • The Company reserves the right to photograph decorations for promotional purposes (websites, social media, marketing), unless the Client explicitly requests otherwise in writing.


Force Majeure

  • The Company may cancel or reschedule services due to unforeseen circumstances beyond its control.
  • In the event of rescheduling due to force majeure, the Company will work with the Client to select an alternate date within reasonable availability. 
  • If the Company cancels, all payments made by the Client will be refunded in full.



ACKNOWLEDGMENT

BY SUBMITTING A DEPOSIT OR PAYMENT, THE CLIENT CONFIRMS THEY HAVE RECEIVED, READ, AND UNDERSTOOD THESE TERMS OF SERVICE, AND THAT SUCH PAYMENT CONSTITUTES A BINDING ELECTRONIC SIGNATURE TO THIS AGREEMENT.
